Apparently the Attorney General, Ana Matilde Gomez has not been able to find the file about the trial and alleged acquittal of Delgado Diamante.
Gómez said that she has requested the documents from the National Archives of the Judicial Organ and the Public Ministry, but so far she has not found those papers.
“We still have time to find the files, to move the investigation forward without committing any procedural failures,” said Gomez.
Meanwhile, Delgado Diamante continues to claim his innocence and has launched a lawsuit against the Democratic Citizens Network leaders, which has accused him of the murder of Felix Solorzano.
The judge of the Second Tribunal of Justice at that time, Donatilo Balleteros said that the legal process against Delgado Diamante never went to the justice tribunals and for that reason the Public Ministry must open the case.
Over the last few days former military officers have made contradicting statements about how the case was handled by the former Defense Forces.
Delgado Diamante has insisted from the beginning that he was cleared of all charges of murder at the time.
